Welcome to kemour.com. These Terms of Service (“Terms”) are a legally binding agreement between you (“you,” “your,” or “customer”) and Kemour (Kemour LLC) (“we,” “our,” or “us”). By visiting our website, creating an account, or making a purchase, you agree to these Terms. Please read them carefully.

1. Eligibility & Website Use

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this website.
You agree to use the website for lawful purposes only and in a manner that does not violate applicable laws, infringe on the rights of others, or harm the website’s functionality.
Prohibited activities include, but are not limited to, attempting to gain unauthorized access to our systems, distributing malware, engaging in fraudulent transactions, or interfering with site operations.

2. Account Responsibilities

If you register for an account, you must provide accurate and complete information.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
If you suspect unauthorized access to your account, notify us immediately at support@kemour.com.

3. Orders, Pricing, and Payments

All orders are subject to acceptance and product availability.
Prices may change without prior notice but will not affect confirmed orders.
We reserve the right to cancel any order suspected of fraud or pricing errors.
Payments are processed securely through trusted third-party providers. Kemour does not store full credit card numbers on its servers.

4. Shipping & Delivery

Handling Time: Orders are typically processed within 1-2 business days after payment verification.
Transit Time: Most orders are delivered within 2–4 business days via UPS or FedEx Ground.
Shipping Coverage: We currently ship to all 50 U.S. states, including Alaska, Hawaii, Puerto Rico, Guam, the U.S. Virgin Islands, APO/FPO addresses. International shipping is not available at this time.
Delivery Risk: Once a package is marked as delivered by the carrier, the risk of loss transfers to the customer.

5. Lost or Damaged Packages

If your package is lost in transit, contact us within 10 business days of the expected delivery date so we can file a claim with the carrier.
If your order arrives damaged, email us photos within 72 hours of delivery to request a replacement or refund.
Kemour is not responsible for losses caused by incorrect shipping addresses provided by the customer.

6. Returns & Exchanges

Return Window: You may return eligible items within 30 days of receiving your order.
Condition: Items must be unworn, unwashed, in original packaging, with all tags attached, and include proof of purchase.
Return Shipping: Customers are responsible for return shipping costs unless the product is defective or we shipped the wrong item.
Refunds: Approved refunds are processed to the original payment method within 14 business days. Your bank may take an additional 3–5 business days to post the credit.
Exchanges: We only offer exchanges for defective products, incorrect items shipped, or manufacturer sizing errors. For a different size or style, please place a new order.

7. Intellectual Property

All content on kemour.com, including text, images, graphics, logos, and product designs, is owned by Kemour LLC or its licensors and protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works without prior written consent from Kemour LLC.

8. Disclaimer of Warranties

Our website and services are provided on an “as is” and “as available” basis. Kemour makes no warranties that the website will be uninterrupted, error-free, or free from harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Kemour LLC will not be liable for any indirect, incidental, or consequential damages, or for losses caused by carrier delays, force majeure events, or circumstances beyond our reasonable control.
Our maximum liability will not exceed the total amount you paid for the order in question.

10. Indemnification

You agree to indemnify and hold harmless Kemour LLC, its employees, and partners from any claims, damages, or expenses arising from your misuse of the website, violation of these Terms, or infringement of third-party rights.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and the State of Nevada.
Any disputes will be resolved in the courts located within Nevada, except where prohibited by law.

12. Changes to These Terms

We may update these Terms of Service from time to time. When changes occur, the “Last Updated” date at the top of this page will be revised. Continued use of the website after updates means you accept the revised Terms.
